These Terms of Use (“Terms”) govern your access to and use of GateHopper’s website, apps, and services (the “Services”). By using the Services, you agree to these Terms.

1. Who We Are

GateHopper (“GateHopper”, “we”, “us”) provides a platform that helps users discover events and purchase tickets, and helps organizers create events and sell tickets.

2. Eligibility & Accounts

  • You must use the Services only if you can form a legally binding contract where you live.
  • You are responsible for keeping your login credentials secure and for all activity on your account.
  • You agree to provide accurate information and keep it updated.
  • We may suspend or terminate accounts for security reasons or violations of these Terms.

3. Using the Services

You agree not to misuse the Services. For example, you will not:

  • break any laws or third-party rights;
  • attempt to bypass security, scrape data, or reverse engineer the Services;
  • use bots or automated methods to access the Services without our permission;
  • interfere with the Services’ operation (including introducing malware);
  • impersonate another person or misrepresent your affiliation.

4. Tickets, Entry, and Event Rules

Tickets sold through GateHopper may be delivered digitally (including QR codes or mobile wallet passes). Entry is subject to venue and organizer policies, which may include security screening, age requirements, bag restrictions, accessibility rules, and conduct policies.

  • Ticket validation: Tickets may be scanned at the event. A ticket that has already been scanned (or reported as compromised) may be invalidated.
  • Late entry: Late arrival may result in delayed or denied entry depending on event rules.
  • Lost access: If you lose access to your device or wallet, you may still be able to access tickets via your GateHopper account (subject to security checks).

5. Orders, Pricing, Fees, and Taxes

Prices, fees, and taxes (if applicable) are shown during checkout. By placing an order, you authorize the charge for the total amount displayed.

  • All sales may be final unless otherwise stated at checkout or required by law.
  • We may limit quantities per customer, per payment method, or per account.
  • We may cancel orders that appear fraudulent, violate these Terms, or are due to pricing/availability errors.

6. Refunds, Cancellations, and Changes

Refund eligibility depends on the organizer’s policy, the event’s status, and applicable law. If an event is postponed, rescheduled, moved, or cancelled, the organizer may set the available options.

  • Event changes: date/time/location/lineup changes may occur and are not always grounds for refund.
  • Cancelled events: if a refund is offered, it is typically issued to the original payment method.
  • Chargebacks: initiating a chargeback may delay support and may result in account restrictions.

7. Transfers, Resale, and Prohibited Conduct

Some tickets may be transferable, and others may be restricted by the organizer, venue, or law. You agree not to:

  • resell tickets where prohibited, or at prices that violate local laws;
  • use GateHopper to facilitate fraud, scams, or misleading listings;
  • circumvent ticket limits or attempt to obtain tickets through automation;
  • upload or share invalid, duplicated, or stolen tickets.

We may invalidate tickets, cancel orders, or suspend accounts if we reasonably believe these Terms were violated.

8. Organizer/Seller Terms

If you create events or sell tickets on GateHopper (“Organizer”), you are responsible for your events and everything you publish, including pricing, policies, disclosures, and compliance with laws.

  • Accuracy: You agree to provide accurate event details and update changes promptly.
  • Policies: You must clearly communicate refund, entry, age, and accessibility policies.
  • Compliance: You are responsible for permits, safety, consumer laws, and tax obligations.
  • Payouts: Payout timing, reserves, or holds may apply for fraud prevention, refunds, or disputes.
  • Support: Organizers may be required to respond to attendee inquiries within reasonable timeframes.

9. User Content

You may be able to submit content (like event descriptions, images, reviews, or support messages) (“User Content”). You retain ownership of your User Content, but you grant GateHopper a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), display, and distribute it for operating and promoting the Services.

You represent that you have the rights to post the User Content and that it does not violate any laws or rights.

10. Intellectual Property

GateHopper and its logos, design, software, and other content are owned by GateHopper or its licensors and are protected by intellectual property laws. You may not use our branding without written permission.

11. Third-Party Services

The Services may integrate with or link to third-party services (for example: payment processors, mobile wallet providers, maps, analytics, or social platforms). Those services are governed by their own terms and policies.

12. Disclaimers

The Services are provided “as is” and “as available”. To the fullest extent permitted by law, GateHopper disclaims warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

GateHopper does not guarantee that events will occur as planned or that the Services will be uninterrupted or error-free.

13. Limitation of Liability

To the fullest extent permitted by law, GateHopper will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill.

To the fullest extent permitted by law, GateHopper’s total liability for any claim relating to the Services will not exceed the greater of (a) the amounts you paid to GateHopper in the 12 months before the claim, or (b) $100 CAD.

14. Indemnification

You agree to defend, indemnify, and hold harmless GateHopper and its affiliates, officers, employees, and partners from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your User Content, or your violation of these Terms.

15. Termination

We may suspend or terminate access to the Services at any time if we reasonably believe you violated these Terms, created risk, or used the Services unlawfully. You may stop using the Services at any time.

Sections that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, and indemnity).

16. Governing Law

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict of laws principles. Courts located in British Columbia will have exclusive jurisdiction, except where prohibited by law.

17. Changes to These Terms

We may update these Terms from time to time. We will post the updated version and revise the “Last updated” date. If changes are material, we may provide additional notice as required by law.
